This is a website and success depends on the interest it gathers. We are therefore going to be more interested in retaining a member who's been with us for say, 3 years over a user who made his account 3 weeks ago. The same can be said of what they add to the site, a user who contributes well and gets involved in conversation etc around the site is more likely to get a warning and a bit of leeway. In general we don't like to ban anyone, there are several offenses that will earn anyone a straight red card, all of these can be read about in the Site Guidelines thread.
I guess the thing to remember is that those users who get in trouble and have been around the site for quite some time have already shown us that they can be a decent user on the site, whereas someone who's just joined the site and causes a problem has very few credentials and is more likely to be a problem user and not worth our time. It's sort of like having an alibi when the evidence is against you, we know that there's a good chance of reforming them so we warn them about what will happen if they persist and monitor them closely to see how they react in the coming days. Hopefully that gives you an idea as to our thought process.
